An IVA is a legal agreement between the individual in debt, and an insolvency service practitioner. The beginning of 2010 has already seen the rise of IVAs and the decline of those declaring bankruptcy, showing us that IVAs are on the rise with those aspiring to be declared debt-free. Those with an IVA aim to pay off a reduced debt sum in monthly instalments in up to 5 years.
IVAs benefit those in employment who want to repay unsecured credit debts. With the amount of debt owed reduced by up to 75% through an IVA, the debtor has the option with an IVA to carry on living comfortably (enough money is left to pay the mortgage, bills, food etc) without worrying about their creditors knocking on the door.
All contact between the debtor and creditor is lost once an IVA is set up, with the insolvency service practitioner the only one who is left to communicate with the creditor. Most creditors are accepting of IVAs as, if the debtor has no other means of repayment, the debtor could face bankruptcy and the creditor would not get any of their money back.
Anyone who's employed or self-employed, and has a current debt of 15,000 or more with 3 or more unsecured creditors, could qualify for an Individual Voluntary Agreement.
